The Planning Board is proposing a series of zoning bylaw articles to regulate Medical Marijuana and Marijuana Establishments.  With the passage of recreational marijuana at the Ballot in November 2016, the Town has been working on regulations on how to permit marijuana establishments within the town.  The state is also developing regulations for marijuana establishments; however, they are currently in draft form.  The Cannabis Control Commission's draft regulations can be found HERE.
 
A public hearing on the proposed articles is scheduled for January 22, 2018 at 7:30 PM in Conference Room A at the Grafton Municipal Building.
 
DESCRIPTION OF ARTICLES AS LISTED BELOW
 
 
  • ZBL 2018-1 Medical Marijuana and Marijuana Establishments Bylaw: Proposed New Grafton Zoning Bylaw amending Section 5, Special Regulations by adding a new ZBL Section 5.10 Medical Marijuana and Marijuana Establishments. 
  • ZBL 2018-2 Amendment to Section 3, Use Regulation Table of the Zoning By-Laws: Proposed Amendment to Section 3.2.3.1, Use Regulation Table of the Zoning By-Laws to add five Business Uses and one Accessory Use.
  • ZBL 2018-3 Amendment to Section 3, Use Regulation Table of the Zoning Bylaws:  Proposed Amendment to Section 3.2.3.1, Use Regulation Table of the Zoning By-Laws, to permit Marijuana Retailers as a special permit use as indicated by "S" within the Community Buiness (CB) Districts.

  • ZBL 2018-5 Amendment to Section 3, Use Regulation Table of the Zoning Bylaws:  Proposed Amendment to Section 3.2.3.1, Use Regulation Table of the Zoning Bylaws, to permit Marijuana Retailers as a special permit use as indicated by "S" within the Village Mixed Use (VMU) Districts.

What is Zoning?

The Town is divided into zones within which various uses are permitted.  Zoning specifies number and types of uses permitted in each zoning area such as residential, agriculatural, commercial, and industrial.  Massachusetts General Law (MGL) Chapter 40A, known as the Zoning Act, gives cities and towns the authority to adopt ordinances and bylaws to regulate the use of land, buildings and structures.

Zoning in Grafton

The current Zoning By-Law and Zoning Map were adopted at Town Meeting on May 12, 1986 and have since been amended throughout the years.  Grafton is divided into nine primary zones: 3 residential zones, agricultural, community business, neighborhood business, office / light industrial, industrial, and village mixed use.  In additon there are a total of four overlay districts which additonally impact the types of uses allowed in those areas.  Section 3.2.3.1 of the Zoning By-law outlines a wide range of allowed or conditionally permitted uses per zone.

Planning Board Duties Relating to Zoning Changes

The Planning Board holds public hearings and makes recommendations on proposed zoning amendments. State Law (MGL 40A, Section 5) requires that the Planning Board conduct a public hearing and present its report to Town Meeting on all proposed zoning amendments which have placed on the Town Meeting Warrant. A two thirds vote of Town Meeting is required to pass zoning amendments.
